How to File a Claim for a Lyft Crash
You can report an accident to Lyft through the rideshare company’s app or website. The process to file your claim can take about 10 to 15 minutes. Your Hamilton Lyft accident lawyer can guide you through this process.
Expect your lawyer to explain what to do after a car accident involving Lyft, including what the claims process entails. Ideally, your attorney can negotiate an insurance settlement covering your tangible and intangible accident losses. If you accept an insurance settlement proposal, your claim will be resolved without any further action needed.
Unfortunately, even if you have a valid claim, an at-fault party’s insurance company can dispute your compensation request. If this happens, your lawyer can help you file a lawsuit in accordance with the car accident statute of limitations in Ohio.

When to Sue for a Lyft Accident
Under Ohio Revised Code (ORC) Section 2305.10, if you are injured in a Lyft accident and another party is liable, you generally have two years to file a lawsuit. Beyond this window, you can lose the right to sue at a later time.
Your rideshare accident attorney can answer any questions you have about how much it costs to file a lawsuit in Ohio and other topics specific to your situation. Sometimes, your lawyer can get you compensation for your Lyft accident losses through an insurance claim. Outside of this, your attorney can continue to prepare your case as if it will go to trial.
If you sue for damages, your attorney can keep negotiating a settlement with a liable party before your trial date. Of course, if you don’t receive a reasonable settlement offer, your lawyer can argue your case in court and explain to a judge or jury why you should be awarded compensatory damages.

Types of Compensation You Can Get in a Lyft Collision Case
Your recoverable damages will be based on the losses you’ve incurred in a Lyft accident. Some of the reasons why your lawyer can request economic and non-economic damages for your Lyft accident losses include:
- Pain and suffering
- Loss of income
- Decreased earning capacity
- Medical bills
Based on ORC Section 2315.33, if you sue for injuries from a Lyft accident, you are subject to modified comparative negligence. This means that if you’re 50% or less liable for your accident, you can still recover damages, but they can be reduced by your percentage of fault. Or, if you’re more than 50% to blame, you are ineligible to recover damages.
How to Prove Negligence in a Lyft Crash Case
Trust your attorney to put together an argument designed to prove that a party committed a careless act, which represents a breach of their duty of care. Such an act can range from driving a Lyft while intoxicated to the rideshare company allowing a motorist who lacks proper training or experience to accept ride requests.
Your attorney wants to illustrate that because this duty was violated, you were harmed in a Lyft accident. They can highlight the timeline of events that led to your accident, which can help prove that someone else was negligent and should be held liable for the incident, your injuries, and your damages.
As your lawyer develops your argument, they can retrieve rideshare app data, witness statements, accident scene photos and videos, and other evidence. If your attorney has relevant proof, they will be well-equipped to show a judge or jury why you should be compensated for your rideshare accident losses.
Who Can Be Held Liable for a Lyft Collision
The party responsible for your Lyft collision varies based on who was involved in the incident and how their actions contributed to it. Your attorney can investigate your collision as they assess liability. Some of the parties that can be held potentially responsible for the incident include:
- Lyft
- Rideshare driver
- Another motorist
- Automaker
- Car parts manufacturer
- Mechanic
Your attorney can review police reports, interview witnesses, and take other measures as part of their case investigation. This can also help your lawyer collect evidence and lay the foundation for your legal strategy.
