The Importance of Seeking a Wrongful Death Claim
Your family member is gone. The police may have charged the driver with a crime. Seeking a wrongful death claim is much different, and sometimes just as important. A civil lawsuit against the at-fault party allows you to recover critical compensation while getting justice.
Under Illinois law 740 ILCS 180/2, a personal representative can bring a wrongful death claim. This person is either named in the will of the deceased or appointed by the court. This person seeks the wrongful death claim on behalf of the heirs, such as the spouse, descendants, or, if they do not exist, the parents.
This process allows family members to receive compensation from the at-fault party to continue meeting their needs. If your loved one was a wage earner in your home, the reality is that their death will be financially challenging. Not only do you have to cover final expenses, but you also need to think of the future. Let us help you seek fair compensation.

What Families Can Recover in a Wrongful Death Claim
The Illinois Wrongful Death Act (740 ILCS 180) allows surviving family members to bring a claim against the at-fault party. Your Orland Park fatal car accident attorney will explore all types of losses you have to create a maximized claim.
Some of the damages recoverable by the family itself include:
- Loss of financial support previously provided by the deceased family member
- Loss of companionship and guidance
- Funeral and burial costs
- Loss of services, such as providing help around the home or childcare
These are losses you will continue to experience going forward as a result of your loved one’s death. If you are the spouse or child of a person who was killed by the reckless driving of another party, reach out to us for immediate help. If there is no spouse or child, the parents can seek legal action for their losses.
Additional Damages Recoverable by the Personal Representative
The personal representative of the deceased party can seek compensation for any losses suffered by the victim. This is done under the Illinois Survival Act. It covers the damages the deceased person suffered and would have recovered had they survived.
This includes losses related to medical care received prior to death, lost income from the time of the accident until death, and pain and suffering they experienced prior to death.
How the Court Places a Value on Someone’s Life
This is one of the most challenging aspects of filing a wrongful death claim. Determining the true value of a person’s life is never simple and often depends on many factors.
These include age, education, earning capacity, and health. Let our Orland Park wrongful death lawyers work with financial experts to accurately evaluate your claim.
