What Makes a Hit and Run Accident Claim Challenging
Ohio law requires everyone involved in a collision to stop and exchange information. A driver who leaves the scene of the accident may face misdemeanor charges. However, the outcome is even more challenging for victims with injuries.
If you don’t know who hit you, it becomes harder to seek fair compensation for your losses. Police will investigate, and many times they identify the fleeing driver. That means you can then file a claim. But that does not always happen.
In some situations, you may be able to file an uninsured motorist claim if you purchased that policy, but not everyone carries it. That can make it even harder to recover damages from an accident you did not cause.
To minimize risks to your future, hire our team to pursue legal action for you. Let us do the hard work so you get the results you deserve.

What Our Hit and Run Accident Attorney Can Do for You
In these challenging cases, having a legal advocate to fight for you can prove critical. You can trust that Postman Law will bring the resources and tools to your case to identify who is at fault.
When you choose to work with us, you can expect us to handle the following:
- A full investigation to determine the identity of the at–fault party. This is where it starts. We gather witness statements, seek dash camera footage, work with third parties, and use other resources to identify who hit you.
- We also look at other parties that could be at fault. Often, more than one party can be held accountable. This could include employers, other drivers on the roadways, or even a local restaurant that overserved a driver with alcohol, causing the accident.
- Fight any claims against you. We will work to prove you were not at fault for the accident in any way. This often becomes necessary to show your own insurance company the damages they owe you.
- Handle the claims process with your underinsured motorist policy. If you must file a claim against your insurer, we represent you in pursuing the maximum compensation allowed under the law.
- Go to court when we need to. In rare cases, our legal team will go to court to fight for fair compensation if the insurance company is unfair or you need to pursue assets against the at-fault party.
Hit and run accidents can easily be a complicated and disheartening accident. Yet, with a highly skilled attorney fiercely committed to building your case, you can have peace of mind.
Do not wait to contact our legal team today for the guidance you need. We charge you nothing upfront. You only pay our Mason personal injury lawyer if you win your case.

What Happens When You Are Partially At Fault
Even your own insurance company may seek evidence to prove you are partially at fault for the accident. Doing so may mean they can reduce how much they pay you for your losses.
Under Ohio’s contributory fault laws, Section 2315.33 – Ohio Revised Code, you can seek compensation as long as you are no more than 50% at fault.
If the insurer believes you are responsible for 51% or more of the fault, they no longer must pay you anything for your losses. That can be financially devastating. Our goal will be to prove you are not at fault at all.
If you do share some fault, we work to determine the lowest possible percentage. That is also important. The law allows insurers to reduce the compensation paid to you by the percentage of fault attributed to you. We will work to prove you deserve full compensation for all your losses.
