Colorado Law Specifies Who Can File Wrongful Death Claims
Many accidents can result in death and give you the right to file a wrongful death lawsuit. For example, vehicle accidents, workplace injuries, accidents on another person’s property, faulty products, medical malpractice, and violence can be severe enough to cost someone their life. When this happens, surviving families can pursue a claim.
According to Colorado Revised Statutes § 13-21-201, a decedent’s surviving spouse can file a wrongful death claim within the first year after the decedent’s death. Unless they specify in writing that their children can join the case, the spouse has sole rights to file a claim. If a claim hasn’t been filed by year two, then spouses and children can file together.
Parents can file if there is no surviving spouse or child present to take legal action on behalf of the deceased. However, it’s important to talk to a lawyer first to understand what parameters may exist.

Establishing Liability is Critical in a Wrongful Death Claim
Losing a loved one because another party’s preventable actions caused their death is a horrible loss that can affect the rest of your life. When another party has acted so egregiously, you can hold them accountable on your loved one’s behalf.
You can provide evidence of their wrongdoing and how your loved one suffered the consequences. During your case, we show the following elements:
- Duty: Denotes the level of safety the other party owed your loved one. This element creates the foundation of your case.
- Breach: This element shows the other party’s specific actions and how they were in direct conflict with the duty they owed you.
- Cause: Refers to the connection between the other party’s breach of duty and the resulting accident. This is the linchpin element.
- Damages: Establish the various losses that you have suffered because of the accident. The at-fault party can be held responsible for paying for your damages.
Postman Law can guide you through this process so you can get justice for your loved one. Liability plays a critical role in a wrongful death claim. It ensures that the opposing party takes responsibility for their actions and that you can recover compensation from them. Our team customizes your case to your circumstances with the available evidence and our effective strategies.

Talk to a Lakewood Wrongful Death Lawyer About the Evidence You Need in Your Case
In a wrongful death case, you must provide evidence of how the other party caused your loved one’s death. While this sounds overwhelming, there are some forms of evidence that are naturally acquired, and a Lakewood wrongful death attorney can fill in gaps with evidence they can access.
Some forms of evidence remain the same across accidents, while others are unique. Evidence can include the following:
- Police reports
- Incident reports filed with commercial properties or workplaces
- Photos and videos of injuries, the scene, and surroundings
- Video surveillance footage from traffic cameras, property security cameras, or vehicle dashcams
- Medical records related to the accident and medical history as applicable
- Data from phone apps, GPS, and black boxes as applicable
- Autopsy report
- Death certificate
- Repair or replacement estimates for damaged property
- Financial information such as tax returns and pay stubs to show lost income
These forms of evidence are not an exhaustive list, and a lawyer can help you determine the specific types of evidence you need to build a robust case against the negligent party. The strength and quantity of your evidence can affect the success of your case, and Postman Law works diligently to ensure it is as solid as possible. We also skillfully and strategically fight for you with the information we’ve gathered.
